Or: what happens when things go wrong (they will)
Welcome to the Underperform Returns & Refund Policy. The fact that you are reading this suggests that something did not go according to plan. We respect that. Acknowledging when things go sideways is, in fact, our entire brand identity.
This policy complies with EU Directive 2011/83/EU on consumer rights and all applicable regulations in Bulgaria, Romania, Greece, and other EU member states. We didn't want to write a compliant policy, but we did it anyway. Classic us.
The 14-Day Cooling-Off Period
Under EU law, you have 14 calendar days from the day you receive your order to return it for any reason whatsoever — including but not limited to: buyer's remorse, the sudden realization that a t-shirt saying "I peaked in 2019" hits a little too close to home, or simply the fact that you changed your mind.
No explanation needed. You don't owe us one. We're used to not meeting expectations.
To exercise your right of withdrawal, inform us at oops@underperform.com before the 14-day period expires. A subject line of "I regret this" is optional but appreciated.
What We'll Accept Back
We will accept your return if the item is:
- Unworn, unwashed, and in its original condition
- Free from perfume, deodorant, or the lingering scent of regret
- Accompanied by the original packaging, if still intact (no pressure)
We will not accept returns for items that have been worn, even once, even briefly, even "just to see how it looks." You know what you did.
Exception: if the item arrived defective, misprinted, or otherwise not as described — that one's on us. We underperformed. See § 4.
The Process (Manageable, We Promise)
Returning an Underperform item involves the following three steps, which we have kept simple because complexity, frankly, is not our strong suit either:
- Step 1. Email oops@underperform.com with your order number and reason for return (optional, but cathartic).
- Step 2. We'll send you return instructions within 2 business days. Or 3. We're trying.
- Step 3. Ship the item back. Return shipping costs are your responsibility, unless the item arrived defective — in which case we'll cover it and apologize sincerely.
When We're Clearly at Fault
If your order arrived with a misprint, wrong size, damaged product, or — in an extraordinary act of irony — with the wrong quote on it, we will:
- Send you a replacement at no extra cost, or
- Issue a full refund including original shipping fees
Your choice. We will not argue. We messed up. It is on brand, but it is still not acceptable from a consumer rights standpoint, so we will fix it.
Please provide a photo of the defective item when you contact us. We are not calling you a liar — we just need it for quality control with our print-on-demand partner, who also occasionally underperforms.
Getting Your Money Back
Once your return is received and inspected (within a reasonable time frame that we will try very hard not to exceed), we will process your refund to your original payment method within 14 days.
Original shipping costs are non-refundable unless the return is due to our fault. We know. It's annoying. It's also EU law, and even we have to comply with things we'd rather not.
If 14 days pass and you haven't received your refund: check your bank account first. Then check your spam folder. Then contact us at oops@underperform.com. We may have simply not gotten around to it yet. That would be on us.
The One Time We Won't Take It Back
Items personalized or customized to your specifications cannot be returned under the EU consumer rights withdrawal right — unless they arrive defective. This is a standard legal exception, not us being difficult. We are, if nothing else, consistent.
The Part We're Legally Required to Tell You
Nothing in this policy affects your statutory rights under applicable EU and national consumer protection laws. You have a 2-year legal guarantee on all products. If something is wrong with your item within that period, you have remedies available to you regardless of what we say here.
We are based in Bulgaria and operate across the EU. Applicable law is Bulgarian law, without prejudice to any mandatory consumer protections in your country of residence.
