Please read these. We did our best writing them.
The Basics
These Terms of Service ("Terms") govern your use of the website located at weunderperform.com ("Website") and any purchases made through it. The Website and the Underperform brand are operated by Subscription Box Ltd., registered in Bulgaria under company number 204684672, with registered address at Sofia, 5, Chudomir Str., fl. 5, ap. 21, ("we", "us", "Underperform").
By accessing this Website or placing an order, you agree to these Terms. If you do not agree, please do not use the Website. We say this with no hard feelings — genuinely.
These Terms were last updated on 28.05.2026. We will notify you of any significant changes. Whether you notice the notification is, respectfully, out of our hands.
Who Can Use This Website
You must be at least 16 years old to place an order on this Website. By purchasing, you confirm that you meet this requirement. If you are under 16, we appreciate your taste in ironic apparel, but please ask a parent or guardian to complete the purchase.
You also confirm that the information you provide — name, address, payment details — is accurate and your own. Ordering a t-shirt to someone else's address without their knowledge is both legally problematic and, frankly, a lot of effort.
When You've Actually Bought Something
Placing an item in your cart and reaching the checkout does not constitute a binding order. A contract between you and Underperform is formed only when we send you an order confirmation email. Until that email arrives, we reserve the right to decline your order — for example, if an item is out of stock or if there has been a pricing error on our end.
Pricing errors do happen. When they do, we will contact you before proceeding and give you the option to purchase at the correct price or cancel entirely. We will not silently charge you more. That would be the kind of underperformance we are not proud of.
All prices are displayed in EUR and include VAT where applicable under Bulgarian and EU law. Shipping costs are shown separately at checkout and are not included in the displayed product price.
What You Are Buying
Underperform sells printed t-shirts produced on demand. This means each item is manufactured specifically for your order after you place it. Production typically takes 2-3 business days before shipping.
We make every effort to represent our products accurately — colours, sizing, print placement. However, screens differ, prints vary slightly from item to item, and the human beings involved in the process are exactly the kind of people our brand is about. Minor variations are not defects.
Significant defects — misprints, wrong items, damaged goods — are covered under our Returns & Refund Policy, which forms part of these Terms.
The Part Where Money Changes Hands
Payment is due in full at the time of ordering. We accept bank payment, credit card payment, and some day even cash on delivery, although we hate it. All transactions are processed securely. We do not store your card details — this is handled by our payment processor, who hopefully performs better than we do.
If your payment is declined, your order will not be confirmed. We will not chase you about it. The ball, at that point, is in your court.
Getting Your Order to You
We ship to Bulgaria, Romania, Greece, Hungary, Croatia, Slovenia, Slovakia, Czech Republic, and other countries as listed at checkout. Estimated delivery times are provided at checkout and are, as the word "estimated" implies, not a guarantee. Delays can occur due to production, carrier capacity, customs, or general forces of nature that are entirely outside our control and frankly outside anyone's.
Risk of loss passes to you upon handover to the carrier. If your order is lost in transit, contact us at oops@weunderperform.com and we will do our best to resolve it — which in this case will likely mean quite a lot.
For EU deliveries: if your order does not arrive within 30 days of the confirmed dispatch date, you have the right to cancel and receive a full refund under EU consumer law.
When Things Don't Work Out
Returns and refunds are governed by our Returns & Refund Policy, which is available on the Website and incorporated into these Terms by reference. Your statutory rights under EU Directive 2011/83/EU and applicable national law are not affected by anything in these Terms.
Our Stuff Is Our Stuff
All content on this Website — including the Underperform name, logo, t-shirt designs, and copy — is owned by or licensed to us and protected by applicable intellectual property law. You may not reproduce, copy, or distribute any of it without our prior written consent.
Purchasing a t-shirt gives you the right to wear it, wash it, and feel complicated feelings about it. It does not give you the right to reproduce the design commercially or claim it as your own. We worked hard on these. Sort of.
What We Are and Are Not Responsible For
To the fullest extent permitted by applicable law, Underperform's total liability for any claim arising from your use of this Website or purchase of our products shall not exceed the amount you paid for the order giving rise to the claim.
We are not liable for indirect, incidental, or consequential damages — including, but not limited to, loss of profits, loss of data, or reputational damage caused by wearing one of our t-shirts to an important meeting. You knew what you were buying.
Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law. We are self-deprecating, not reckless.
Your Personal Data
We process your personal data in accordance with our Privacy Policy, available on the Website. We collect only what we need to fulfil your order and comply with our legal obligations. We do not sell your data. We are an ironic t-shirt brand, not a data broker — there is a difference and we intend to maintain it.
When We Update This Document
We may update these Terms from time to time. When we do, we will post the revised version on the Website with an updated date. For material changes, we will also notify you by email if you have an account or an active order. Continued use of the Website after changes take effect constitutes your acceptance of the new Terms.
We recommend checking this page occasionally. We understand if you don't.
If It Ever Comes to That
These Terms are governed by Bulgarian law. For consumers resident in other EU member states, you retain the benefit of any mandatory protective provisions of the law of your country of residence.
If you have a complaint, please contact us first at oops@weunderperform.com. We would genuinely prefer to resolve it directly. If we cannot reach an agreement, you may refer the matter to the relevant alternative dispute resolution body in your country. In Bulgaria, this is the General Conciliation Commission at the Consumer Protection Commission (КЗП).
